1. Who Can Use Evolv

You must be at least 18 years old to use the Service. By using Evolv, you represent that you are 18 or older and able to enter into this agreement.

2. Not Medical Advice

Evolv is a wellness and self-help tool designed to support people working toward sobriety and healthier habits. Evolv is not a medical device and does not provide medical advice, diagnosis, or treatment. The Service, including the Elder AI feature, is not a substitute for professional medical care, therapy, counseling, or addiction treatment.

Always seek the advice of a qualified health provider with any questions about a medical or mental-health condition. If you are experiencing a medical emergency, or are thinking about harming yourself, call your local emergency services immediately. In the U.S., you can call or text 988 (Suicide & Crisis Lifeline). Never disregard professional advice or delay seeking it because of something in the Service.

3. Your Account

You are responsible for keeping your account secure and for the activity that happens under it. Please provide accurate information and let us know if you believe your account has been compromised.

4. Subscriptions, Free Trials, and Billing

Evolv offers an optional premium subscription ("Evolv+"). The following terms apply when subscriptions are available:

• Free trial. We may offer a free trial (for example, 7 days). If you do not cancel before the trial ends, your subscription begins and you will be charged for the plan you selected.
• Auto-renewal. Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless you cancel at least 24 hours before the period ends. Your account is charged for renewal within 24 hours before the end of the current period.
• Pricing. Plan prices are shown in the app before you purchase. Prices may change, and we will give notice where required.
• Payment. Purchases are processed by the app store you downloaded Evolv from (such as the Apple App Store or Google Play) and managed through RevenueCat. Payment is charged to your app store account.
• Managing and canceling. You can manage or cancel your subscription anytime in your app store account settings. Deleting the app does not cancel your subscription.
• Refunds. Refunds are handled by the app store in accordance with its policies. We generally cannot issue refunds directly.

5. Acceptable Use & Community Guidelines

Evolv includes community features that let you post content and interact with other members. You are responsible for the content you post. When using Evolv, including any community features, you agree not to:

• Harass, bully, abuse, threaten, impersonate, or harm other people;
• Post content that is unlawful, hateful, defamatory, sexually explicit, or that promotes or facilitates the sale or use of illegal drugs, self-harm, or harm to others;
• Post spam, advertising, or scams;
• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service;
• Use the Service for any unlawful purpose.

There is no tolerance for objectionable content or abusive behavior. We use automated content filtering and member reporting to help keep the community safe, and we reserve the right to remove any content and to suspend or terminate the account of any member who violates these Terms, at our sole discretion.

You can report objectionable content or block another member at any time using the tools available in the app. We review reports and will act on objectionable content and the members responsible — including removing the content and ejecting the member who provided it — within 24 hours.

Community posts reflect the views and experiences of individual members, not Evolv, and are not medical advice. If you are in crisis, call or text 988 (Suicide & Crisis Lifeline) or call your local emergency services. To report a concern outside the app, contact us at hello@evolv.now.

6. Your Content

You keep ownership of the content you create in Evolv, such as journal entries and reasons. You grant us a limited license to store, process, and display that content as needed to operate the Service for you (for example, syncing it across your devices). You are responsible for the content you share in any community features.

7. The Elder AI Feature

Elder is an AI-powered support feature that generates responses automatically. Its responses may be inaccurate or incomplete and should not be relied upon as professional advice. By using Elder, you understand that your messages are processed by third-party AI providers to generate responses, as described in our Privacy Policy.

8. Intellectual Property

The Service, including its design, branding, and software, is owned by Evolv and protected by intellectual property laws. We grant you a limited, personal, non-transferable license to use the Service for your own non-commercial recovery journey. You may not copy, resell, or redistribute the Service.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will achieve any particular result for you.

10. Limitation of Liability

To the fullest extent permitted by law, Evolv and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or related to your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or $50.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Some provisions, by their nature, survive termination.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Connecticut, USA, without regard to its conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Connecticut, unless applicable law requires otherwise.
